Topic of the thesis: Exploring the role of the legal frameworks of contractual type pension schemes on the principal-agent relationships in these schemes in Italy and Turkey

Abstract: Principle-agent relationships in private pension systems do not function in a vacuum. Thus, examining the principal-agent relations in pension systems including the legal framework is a necessity not only for protecting participants from the misconducts of their agents but also for increasing the overall efficiency of the system. Considering the resemblances in their welfare regimes, similarities between their private pension systems are not unexpected. Yet, there are significant differences between the legal frameworks of these contractual pension schemes in Italy and Turkey. The differences lead to discrepancies in the types and the prevalence of agency problems in these schemes.   This proposed research will focus on agency problems in contractual type pension funds in Turkey and Italy. The main aim of this proposed research is to answer the following question: How do the legal frameworks of contractual type pension schemes in Italy and Turkey predispose the schemes to agency problems?   For this aim, the proposed research will rely on a mixed-method analysis of the secondary legal data, i.e., the body of current law, by-laws, and court verdicts. Comparative analyses of the legal frameworks of these schemes will deliver fruitful results in understanding how the legal framework of a contractual pension scheme can be reformed for increasing its capability of prohibiting agency problems.
